ACT rules
When a patio or pergola needs approval
- Development application: a roofed patio needs none if its roof is no more than 50 m², it has walls on no more than 2 sides, it's no more than 3 m high, and it's behind the front of the house.
- Building approval: none needed if it has no walls, it's no more than 3 m high, the roof is no more than 25 m², and no beam spans more than 4 m unsupported.
- The general rules still apply either way: within 1.5 m of a side or back boundary, heritage, easements and protected trees can all mean you need approval.
